THERE HAS BEEN NO CHANGE TO PUBLIC CHARGE
Advancing Justice-LA Urges Families to Stay Calm
LOS ANGELES, CA -- Asian Americans Advancing Justice - Los Angeles encourages families to continue using public benefits such as Medicaid (MediCal in California), SNAP (CalFresh in California), food stamps, WIC, and other housing, energy, and transportation programs.
Recently, major news networks and media outlets have provided incorrect information about the proposed changes to public charge rules. Below are the facts about what is currently happening to public charge.
- Though the Trump Administration has been threatening to release changes to public charge rule for months, the proposed changes are still not approved or implemented. The proposed changes to the public charge rule are still in draft form and they have not been released.
- Public charge rules do not affect citizenship applicants or immigrants with humanitarian visas such as T and U visa applicants, refugees, asylees, Violence Against Women Act (VAWA) petitioners, special immigrant juveniles and certain other immigrants.
- If the Trump Administration releases proposed changes to the public charge rule, everyone will have a chance to speak out and submit comments about the rule before it is finalized. Reviewing the comments can take months and some rules are never finalized.
The benefits families use now will not affect green card applicants because the public charge rule has not been finalized and it will not be retroactive.
